Hover Point LLC - Terms and Conditions Terms and Conditions 1. Introduction These Terms and Conditions govern all drone photography services provided by Hover Point LLC, based in Virginia. By booking a service, the client agrees to be bound by the terms set forth below.
2. Services Provided Hover Point LLC offers aerial photography for residential real estate, land and lot documentation, roof inspections, apartment buildings, construction sites, company showcases, and event coverage. Additional services include photo editing and optional video add-ons.
3. Work Performed All services are currently performed solely by Hover Point LLC without the use of subcontractors.
4. Payment Terms Payment is required in full upfront unless otherwise agreed upon in writing. Accepted payment methods include credit/debit cards, PayPal, cash, and checks.
5. Cancellation & Refund Policy Clients may cancel up to the date of the photoshoot or are subject to a 50% penalty. If weather or FAA restrictions prevent the shoot, a full refund will be issued unless a reschedule is agreed upon.
6. Scheduling and Rescheduling Bookings must be made at least 48 hours in advance unless otherwise discussed. Rescheduling is allowed with at least 24-hour notice. Weather-related changes may occur at no cost.
7. Deliverables Clients will receive high-resolution, professionally edited images. The number of images is based on the selected package and any add-ons. Photos are delivered via Google Drive within 48 hours for standard shoots and 3-4 business days for shoots including video. Page 1 Hover Point LLC - Terms and Conditions
8. Copyright & Usage Hover Point LLC retains full copyright of all media. Clients are granted a license to use the content for company advertising and promotional use only. Clients may not resell, redistribute, or alter the content. Hover Point LLC may use the content for its own marketing and portfolio purposes.
9. FAA Compliance & Safety Hover Point LLC is FAA Part 107 certified and insured (coverage pending). Flights will not occur over people or unsafe areas. The company reserves the right to cancel or reschedule any shoot deemed unsafe, with a full refund issued.
10. Property Access & Airspace Hover Point LLC will check airspace legality before any flight. If a shoot requires flying over private property, the client must secure the necessary permissions. If the flight cannot be conducted legally, a full refund will be provided.
11. Quality Assurance & Client Satisfaction In cases of proven weather interference, a reshoot will be scheduled. Refunds are not issued for dissatisfaction, but a discounted reshoot may be offered. If poor quality is determined to be Hover Point LLC's fault, a free reshoot will be provided.
12. Dispute Resolution Any disputes arising from these Terms will be resolved through binding arbitration in the state of Virginia, rather than through litigation in court.
13. Governing Law These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia.
14. Amendments Hover Point LLC reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of services constitutes acceptance of any changes. Page 2 Hover Point LLC - Terms and Conditions
15. Equipment Malfunction & Data Loss Hover Point LLC is not liable for loss of media or delays in delivery due to drone malfunctions, memory card failures, software corruption, or other technical issues beyond our control. In the rare event of total data loss, a reshoot may be offered if feasible, but no refunds or liability for client losses will be assumed.
16. Environmental & Weather Limitations Clients acknowledge that final media quality may be affected by weather conditions, lighting, air clarity, construction activity, or surrounding obstructions at the shoot location. Hover Point LLC will make every reasonable effort to capture high-quality content, but makes no guarantees regarding specific outcomes or image aesthetics.
17. Property Damage or Injury Hover Point LLC follows FAA Part 107 safety guidelines and takes every precaution to operate safely. However, clients agree to maintain a safe and clear environment for drone operations. Hover Point LLC is not responsible for damage or injury resulting from unsafe conditions, obstacles, or third-party interference. Liability is limited to the amount paid for the specific service rendered.
18. Delivery Timeframes While Hover Point LLC aims to deliver content within 48 hours (photos) or 34 business days (video shoots), these are estimated timeframes. Delays due to weather, technical issues, or scheduling conflicts may occur. Clients agree that Hover Point LLC is not liable for losses resulting from delivery delays.
19. Usage Restrictions Clients are granted a limited, non-transferable license to use delivered media for their own marketing and promotional purposes. Content may not be resold, sublicensed, redistributed, or used by third parties (e.g., media outlets, vendors, or contractors) without prior written permission from Hover Point LLC.
20. Client Acknowledgment By booking a service with Hover Point LLC, the client confirms they have read, understood, and agreed to all Terms and Conditions stated in this document.
